Terms of Service (Conditions Générales de Vente - CGV)

Article 1: Introduction and Scope
These General Terms and Service (hereinafter "CGV") govern all sales made through the kuntroversie website, [Your Website URL], to consumers (hereinafter the "Customer").
By placing an order on the Site, the Customer unconditionally accepts the entirety of these CGV. kuntroversie reserves the right to modify these terms at any time; the applicable version will be the one in effect on the date the order is placed.
Article 2: Products
Our products are presented on the Site with detailed descriptions of their essential characteristics (composition, materials, sizes, colors, etc.). The photographs are as accurate as possible but cannot guarantee perfect similarity with the physical product, particularly due to the technical variations of computer screens.
kuntroversie makes every effort to ensure product information is accurate. However, availability is subject to change. In the event of unavailability after an order is placed, the Customer will be informed promptly and will have the option to modify their order or receive a full refund.
Article 3: Prices
Prices are displayed in Euros (€) and exclude all taxes and shipping costs.
Shipping costs will be clearly indicated to the Customer in the shopping cart before the final validation of the order.
kuntroversie reserves the right to change its prices at any time, but the products will be invoiced based on the price in effect at the time the order is registered.
Article 4: Orders
To place an order, the Customer must select the products, add them to their cart, write the invite code and proceed to checkout. They will be guided through the necessary steps to enter their delivery details and choose a payment method.
The Customer must provide accurate and complete information. An order confirmation email will be automatically sent to the Customer, detailing the products ordered, prices, and delivery information. This email constitutes the conclusion of the sales contract.
kuntroversie reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over a previous order or for any legitimate reason, such as suspected fraudulent activity.
Article 5: Payment
Payment is due immediately upon order placement. The Customer can pay using the following secure methods:
Credit Card (Carte Bleue, Visa, Mastercard) via our secure payment gateway [e.g., Stripe, PayPal].
PayPal.
The transaction is secured using SSL (Secure Socket Layer) encryption. kuntroversie does not have access to the Customer's banking details at any time.
Article 6: Delivery
Delivery is made to the address specified by the Customer during the ordering process. The delivery times indicated on the Site are provided for information purposes only and are not strict deadlines. They run from the date of order validation.
In the event of a delay, kuntroversie will keep the Customer informed and cannot be held liable for any consequences. The risks of loss or damage to the products are transferred to the Customer upon delivery.
Article 7: Right of Withdrawal & Returns
In accordance with French consumer law (Code de la Consommation, Article L.221-18), the Customer has a period of 14 (fourteen) days from the date of receipt of their order to return any product that does not suit them, without having to justify reasons or pay a penalty.
To exercise this right, the Customer must notify us of their decision to withdraw by sending an unambiguous statement to our customer service email: [help@kuntroversie.com]. They can use the Order withdrawal form model provided in the Appendix of these CGV.
The product(s) must be returned in their original condition (unworn, unwashed, with original tags attached) and in their original packaging, to the following address:

Return shipping costs are the responsibility of the Customer. The refund will be processed within 14 days from the date we receive the returned goods, using the same payment method used for the original transaction.
Important: This right of withdrawal does not apply to customized or personalized products made to the Customer's specifications.
Article 8: Warranties & After-Sales Service
All our products are guaranteed against hidden defects for a period of two years from the date of delivery (Article 1641 of the French Civil Code).
In case of a non-conformity or defect, the Customer should contact our customer service at [help@kuntroversie.com] to arrange for a return and, depending on the case, a repair, exchange, or refund.
Article 9: Personal Data
The personal data collected on the Site is necessary for processing orders and managing customer relations. It is processed in compliance with the French Data Protection Act (Loi Informatique et Libertés) and the GDPR.

Article 10: Intellectual Property
All elements of the kuntroversie Site (logos, texts, graphics, images, etc.) are and remain the exclusive intellectual property of kuntroversie EURL. Any reproduction, modification, or use of these elements without our prior written authorization is strictly prohibited.
Article 11: Liability
kuntroversie's liability shall not exceed the total amount of the order. We cannot be held liable for any indirect damages.
Article 12: Disputes and Applicable Law
These CGV are governed by French law.
In the event of a dispute, the Customer is encouraged to first contact kuntroversie customer service for an amicable solution.
If no agreement is reached, the Customer may refer the matter to a mediator or to the competent French courts.
